Reply: Canada Post loses letters

 

The letter "Canada Post loses fundraising letters . . .” was disturbing, as it demonstrates a failure to understand the laws of Canada.

"BullyingCanada" should boot their legal counsel. Whoever their lawyer is, he/she is unfit to stay a member of the Quebec Bar Association for the following he/she should know.  

All pre-confederation British laws are still in force until repealed. These include the anti-Highwaymen and anti-footpad laws of the sixteenth and seventeenth centuries. Whilst we think of a highwayman as a robber in a tricorn hat waving pistols at a stagecoach, in recent years, this has been repeatedly put to the test in the courts, such as National Front versus Royal Mail, in which it is clearly established that it includes any person, holding up, stopping, or losing the mail. Hence, in the UK, like Canada, where these laws are also still in force, a striking postman always faces potential arrest since he is, legally, a highwayman.

Whilst Canada Post is indeed protected against civil action, "BullyingCanada" has full right under Criminal Law to press charges against Canada Post executives on the basis of the anti-highwaymen law in hopes to have them arrested, tried and, if found guilty, face an unlimited fine, term of imprisonment or, as it has never been repealed in Canada, the death penalty.
